12. Entry By Landlord. Landlord reserves the right upon reasonable advance notice <br /> (except in the event of an emergency or for routine day-to-day maintenance or property ' - <br /> management requirements) without interfering unreasonably with Tenant's business to <br /> enter the Premises to inspect the same; e . _ _ _ '. - - '. _ . •- _ • '_ <br /> e _ _ . .-. . _ e . e - -- . ; to show the Premises to prospective <br /> purchasers or tenants only during periods of mutually agreed upon occurrences, to alter, <br /> improve or repair the Premises or any other portion of the Building, all without being <br /> deemed guilty of any eviction of Tenant and without abatement of Rent. Landlord may, in <br /> order to carry out such purposes, erect temporary scaffolding and other necessary <br /> structures where reasonably required by the character of the work to be performed. <br /> Except in circumstances where Landlord unreasonably interferes with Tenant's use of the <br /> Premises and its business, Tenant hereby waives any claim for damages for any injury to <br /> or inconvenience to or interference with Tenant's business, or for any loss of occupancy <br /> or quiet enjoyment of the Premises. Tenant shall have the right to pursue a claim for <br /> damages resulting from Landlord's unreasonable interference with Tenant's use of the <br /> Premises and business. Landlord shall have the right to open said door to the Premises <br /> in an emergency in order to obtain entry to the Premises. Any entry to the Premises <br /> obtained by Landlord by any of said means, or otherwise, shall not be construed or <br /> deemed to be a forcible or unlawful entry into the Premises, or an eviction of Tenant from <br /> the Premises or any portion thereof. <br /> 13. Utilities and Services. <br /> (a) Landlord's Cost. Provided that Tenant is not in default under this Lease, <br /> Landlord agrees to provide water, sewer, electrical and natural gas service, garbage <br /> service, (five nights a week) at no additional cost to Tenant. <br /> Landlord shall not be responsible or liable for any damage, loss or inconvenience caused <br /> or arising by reason of a failure, interruption or disruption of any utility or utility service <br /> where the same is caused in whole or in part by a cause outside the reasonable control of <br /> Landlord. <br /> (b) Tenant's Cost. Tenant shall contract for and pay the cost of all telephone <br /> and data communication services, including any hook-up and/or installation fees and <br /> charges and shall be responsible for janitorial services for its Premises. <br /> 14. Receivership. Landlord may terminate this Lease, if Landlord so elects, with or <br /> without notice of such election and with or without entry or other action by Landlord, if any <br /> of the following events occur: <br /> (a) A receiver is appointed for Tenant's property and the order appointing such <br /> receiver is not set aside or vacated within thirty (30) days after entry thereof; <br /> (b) Tenant shall assign its estate or property for the benefit of creditors; or <br /> (c) This Lease shall, by operation of law or otherwise, pass to persons other <br /> than Tenant without Landlord's prior consent. <br /> 7 <br /> 1 <br />
