Any work performed <br /> prior to the effective date of this agreement shall be at the sole expense and risk of the <br /> RECIPIENT. <br /> The Project described herein expires on and must be completed by June 30, 2007. <br /> The RECIPIENT shall acknowledge and inform the public at their discretion about the <br /> DEPARTMENT's funding participation in this project through the use of project signs and/or <br /> acknowledgement in published materials and reports, the news media, or other public <br /> announcements. <br /> PART 2. PROGRAM BACKGROUND <br /> For the 2005—2007 Biennium, The Department of Ecology has received a Legislative <br /> appropriation in the amount of $2 million from the Local Toxics Control Account. The funding is <br /> earmarked for the installation of retrofit emissions control technology on heavy-duty diesel <br /> vehicles and equipment owned and operated by local governments. Local governments include <br /> cities, counties, or municipal associations, (including port and transit authorities). The goal of <br /> the program is to improve the health and quality of life of those exposed regularly to diesel <br /> exhaust. <br /> Through a competitive application process, the DEPARTMENT has awarded $2 million to <br /> twenty-eight applicants from all areas of the state. The awards were chosen based upon the <br /> health benefits, exposure of sensitive and environmental justice communities, and the suitability <br /> of the fleet in the respective jurisdictions. <br /> PART 3. BUDGET SUMMARY AND CONDITIONS <br /> 1. The Estimated Number of Vehicles to be Retrofitted in this grant is subject to change <br /> based upon the results of the final inspection of target vehicles by the state selected <br /> contractor and availability of funding. <br /> It is the DEPARTMENT's intention to retrofit the identified vehicles with the most suitable <br /> diesel emission reduction equipment within the limits of the Maximum Grant Amount. <br /> The DEPARTMENT has the right to revise the vehicle numbers and retrofit types based <br /> on equipment and vehicle specifications and funding limitations, and amend the <br /> agreement accordingly. The final grant amount reimbursed to the RECIPIENT may differ <br /> from the Maximum Grant Amount identified below and in Part 1 since it shall be based i 7 <br /> upon the number of retrofit technologies actually installed in the vehicles and equipment. <br /> Page 2 of 6 <br />
