U <br /> kms// <br /> Ordinance No. <br /> An Ordinance relating to Authority to <br /> Restrict Access to Certain Areas, Adding a New Section <br /> to the Everett Criminal Code,Title 10 of the <br /> Everett Municipal Code (Ordinance No. 1145-85). <br /> Whereas, the City Council is aware of instances wherein people have crossed <br /> into police restricted areas during emergencies and in doing so endangering themselves or <br /> others and interfering with the performance of police and/or other emergency services; <br /> and <br /> Whereas,restricting access to areas blocked off by barrier tape or by other means <br /> during emergencies will enhance the ability of police and other emergency personnel to <br /> perform their duties and will in certain cases prevent additional hazards to police, <br /> emergency personnel and victims caused by people crossing into the restricted areas; and <br /> Whereas, the City Council deems it important to prevent unauthorized people <br /> from crossing into restricted areas while still allowing for reasonable access to restricted <br /> areas by members of the media for the purpose of news gathering and reporting; <br /> NOW, THEREFORE, THE CITY OF EVERETT DOES ORDAIN: <br /> Section l: Title 10 of the Everett Municipal Code(Ordinance No. 1145-85) is amended <br /> by the addition of the following section: <br /> Authority to Restrict Access to Certain Areas. <br /> A. Whenever a threat to the public health or safety is created by any emergency, an <br /> Everett police officer may restrict or deny access to any persons to the area where <br /> such threat exists, for the duration of such threat, when the officer reasonably <br /> believes the presence of such persons would constitute a danger to themselves or <br /> others or would substantially interfere with the performance of the police or other <br /> emergency services. For purposes of this section, an emergency includes, but is <br /> not limited to an escaped prisoner, a natural disaster, a fire, an explosion, an <br /> accident, a riot, the presence of an armed person, a hostage incident or a bomb <br /> threat. <br /> B. Whenever it appears to be reasonably necessary to investigate, or to preserve or <br /> collect evidence of criminal acts, a police officer may restrict or deny access to <br /> any area. <br /> 1 <br />
