3 <br /> Amendment Six to Regional Pass <br /> and Fare Reconciliation Program Agreement <br /> THIS AMENDMENT is entered into this_day of December 2006,by and <br /> between the CENRAL PUGET SOUND REGIONAL TRANSIT AUTHORITY("Sound <br /> Transit"); the CITY OF EVERETT ("Everett Transit"); KING COUNTY ("King County <br /> Metro"); PIERCE COUNTY PUBLIC TRANSPORTATION BENEFIT AREA <br /> CORPORATION ("Pierce Transit"); and SNOHOMISH COUNTY PUBLIC <br /> TRANSPORTATION BENEFIT AREA CORPORATION)"Community Transit") each <br /> of which is herein referred to individually as a"Party"or collectively as "Parties." <br /> WHEREAS,the Parties executed the Regional Pass and Fare Reconciliation Program <br /> Agreement on January 1, 2002,which implemented regional transfer acceptance and <br /> reconciliation policies in furtherance of the goal of providing customers ease of access to <br /> all transit services in the Puget Sound Region; and <br /> WHEREAS, the Agreement original expiration date was December 31, 2004,but <br /> allowed the Parties to extend the Agreement for three additional one-year periods with <br /> the prior written consent of the General Managers of the Parties; and <br /> WHEREAS, through Amendment One, the Agreement was extended to December 31, <br /> 2005; and <br /> WHEREAS, through Amendment Three, the Agreement was extended to December 31, <br /> 2006; and WHEREAS, the Parties desire to exercise their right to extend the Agreement <br /> for an additional one-year period through this Amendment Six; and <br /> WHEREAS, the Parties are continuing to work toward completion of a replacement <br /> program; <br /> NOW, THEREFORE, in consideration of the mutual covenants contained herein, the <br /> sufficiency of which is hereby acknowledged, the Parties hereby agree to extend the <br /> above-referenced Agreement according to the following terms and conditions: <br /> AMENDMENT TERMS AND CONDITIONS <br /> The above paragraphs of this Amendment are incorporated by reference herein. <br /> Section One. Section 2.a of the Agreement is hereby amended to read as follows: <br /> Section 2 TERM OF AGREEMENT <br /> a) Effective Date. This Agreement shall become effective on January 1, 2002. <br /> Unless terminated as provided herein, this Agreement shall remain in effect until the <br /> earlier of December 31, 2007 or when a viable program replacing the need for and <br /> supporting the goals of this agreement is in place, as reasonably determined by the <br /> 12 <br />
