9 <br /> 2. if overpayments are made; <br /> 3. if payments are made for activities that are later determined to be <br /> ineligible; <br /> 4. if the Project or any part thereof is terminated before completion, <br /> voluntarily or otherwise, which termination constitutes an ineligible activity requiring repayment <br /> to the County's HOME Investment Trust Fund, pursuant to 24 CFR §§ 92.205(e) and <br /> 92.503(b)(2); or <br /> 5. if the Project or any part thereof ceases to qualify as affordable housing <br /> before the period of affordability expires, pursuant to 24 CFR §§ 92.501 and 92.503(b)(1).. <br /> E. Reversion of Assets <br /> Upon expiration or termination of this Agreement, the Agency shall, pursuant to Section IV-H-4 <br /> hereof, transfer to the County (i) any ADDI funds on hand at the time of such expiration or <br /> termination and (ii) its rights in any accounts receivable attributable to the use of ADDI funds. <br /> F. Certification Regarding Lobbying <br /> The Agency shall comply with Attachment H, which is incorporated herein by this reference, <br /> concerning prohibitions and requirements for disclosure and certification related to lobbying. <br /> G. Limitation on Consultant Compensation <br /> The rate of compensation of certain persons providing consultant services shall be limited as <br /> provided by 24 CFR § 92.358. <br /> H. Program Income and Recaptured Funds <br /> 1. Program Income is gross income, revenues and receipts of the Agency <br /> derived from activities assisted with ADDI funds under this Agreement, and is fully defined at 24 <br /> CFR § 92.2. Program Income includes funds Recaptured pursuant to 24 CFR § 92.254, and <br /> also includes income from activities funded with Program Income, with Recaptured funds, or <br /> with matching funds (as that term is defined at 24 CFR § 92.220). Subject to provisions in the <br /> following paragraphs 2 through 5, all Program Income derived from activities assisted with <br /> ADDI funds provided under this Agreement may be retained by the Agency if it is used <br /> exclusively for additional ADDI projects allowed under, and subject to the terms of, this <br /> Agreement. Any such Program Income which the Agency elects not to retain for such use shall <br /> be remitted to the County. <br /> 2. All ADDI Program Income received by the Agency, from this Project and <br /> any other ADDI-assisted programs or projects, shall be deposited in a single, separate ADDI <br /> Program Income account ( the Agency account"). The Agency shall record and maintain <br /> cumulative records of the original source (the ADDI program or project) of each deposit to the <br /> DDI Agreement between Page 13 of 23 <br /> City of Everett and Snohomish County <br />
