4 <br /> ORDINANCE NO. <br /> AN ORDINANCE providing for the adoption of the 2003 edition of the <br /> International Fire Code, as amended by the Washington State Building Code <br /> Council in Chapter 51-54 of the Washington Administrative Code and repealing <br /> Ordinance No. 2360-99, Sections 1 through 12. <br /> Whereas, the City Council finds that this ordinance serves to protect the public health, <br /> safety and welfare; and <br /> Whereas, the City Council finds that the absence of the regulations adopted by this <br /> ordinance would create a public harm and a public nuisance; and <br /> Whereas, the City Council has been advised that the State Building Code Council, <br /> established with authority granted by the state legislature, has adopted and made revisions to the <br /> 2003 edition of the International Fire Code; and <br /> Whereas, the City Council finds that the City is mandated by the State to implement and <br /> enforce the herein adopted code; and <br /> Whereas, the City Charter allows adoption of codes or portions thereof by reference; <br /> NOW THEREFORE,THE CITY OF EVERETT DOES ORDAIN: <br /> Section 1: Short title. This Ordinance shall be known as the"Everett Fire Code". <br /> Section 2: Fire department established. There is hereby established in the City of Everett, the <br /> Fire Department which shall be under the jurisdiction of the Fire Chief, designated by the Mayor. <br /> Section 3: International Fire Code adopted— Code Conflicts. <br /> A. The International Fire Code, 2003 edition, published by the International Code <br /> Council, Inc., including Appendices B, C and D (hereinafter referred to as the"IFC"), as <br /> amended by the State of Washington through its Building Code Council pursuant to <br /> Washington Administrative Code Chapter 51-54, save and except such portions as are <br /> hereinafter deleted, modified or amended are hereby adopted by reference and <br /> incorporated herein as fully as if set out at length herein. <br /> B. One (1) copy of the IFC is on file with the City fire code official, and one (1) copy is <br /> on file with the City Clerk <br /> C. To the extent allowed by RCW 19.27.040, if provisions within the Everett Fire Code <br /> conflict, the Fire Marshal or his designee has discretion to choose which provision shall <br /> apply. <br /> 9 <br />
