This property is currently violating several city codes and ordinances and the owner has failed to make any <br />tangible progress towards compliance. <br />2. Mr. Moreno is not in compliance with Hearing Examiners order dated February 9th 2007. He was to have <br />removed the portions of the main residence that are in violation of the zoning setback ordinance and that were <br />by his own testimony added without required permits. <br />3. Mr. Moreno has failed to obtain the required permits for the removal of the violating structures (per Hearing <br />Examiners order). <br />4. Mr. Moreno has continued to work on or allowed others to work on the non conforming structures since the <br />Hearing Examiners order. <br />5. A stop work order has been posted in an attempt to regulate the noncompliant activities. (stop work order <br />posted 9/9/09) <br />6. The stop work order has been removed by someone other than the building department. <br />7. The detached accessory dwelling identified as building # 2 in the Hearing Examiners order was determined to be <br />exempt from land use action due to the inability of the Planning Department to find conclusive evidence as to <br />historic use. <br />8. Building # 2 has as recently as 9/09 been altered without building permits and evidence suggests that this <br />structure is in violation of Building codes including but not limited to being used as a dwelling. So building #2 <br />may have passed the land use test, but as of yet received building department approvals. <br />This is a brief overview of the known violations. I am quite confident that more violations will be found when an <br />Inspection team is able to obtain access. <br />Steve Ingalsbe and I are available and anxious to bring Mr. Moreno to task for the numerous violations. Perhaps we <br />could get together with you to review strategy. <br />I suggest we bring Mr. Moreno back in front of the Hearing Examiner requesting fines be assessed for his contempt <br />of the prior order and a new strict timeline for abatement of the violations with a strong penalty clause for failing to <br />meet the proposed deadline. <br />Thank you for your efforts, <br />Ted Budden <br />C.
