Chicago Title Insurance Company, dated September 27, 2006; submitted by <br />Appellant <br />All of the exhibits are available for inspection at the Hearing Examiner Pro Tem's Office <br />located at 2930 Wetmore Avenue, 8th floor, Everett, Washington. <br />Based upon a review of the above record, the following Findings of Fact and <br />Conclusions hereby constitute the basis of the decision of the Everett Hearing Examiner <br />Pro Tem. <br />FINDINGS OF FACT <br />On July 17, 2006, Roger Moreno (Appellant) filed an application with the City <br />seeking certification of a nonconforming use (duplex and single-family residence) <br />and certification of nonconforming setbacks and lot coverage for property located <br />at 2019 Rainier Avenue, Everett, Washington (Subject Property). The subject <br />property is identified by Snohomish County Tax Parcel Number <br />40154170090002, legal description "CAPITOL HILL ADD BLK 417 LOTS 9 & <br />10." Exhibit 1, Staff Report, Page 1; Exhibit 2, Appeal Form and Narrative; <br />Exhibit 3, Director's Decision. <br />2. The subject property is a 6,000 square foot residential lot, measuring <br />approximately 50 feet by 120 feet. The property is zoned R-2 Single Family <br />Detached Medium Density (R-2). The purpose of the R-2 zone is to provide for <br />and protect areas of the City for single-family detached and a limited amount of <br />duplex residential use. Pursuant to Table 6.1, EMC Title 19, Chapter 6, the <br />minimum lot area required for a duplex within the R-2 zone is 7,500 square feet. <br />The subject property does not meet this standard.
