This setback was certified as nonconforming .4 <br />In 1966, the City issued a building permit authorizing the construction of a 20-foot <br />by 24-foot carport addition to the rear of the structure. The Appellant conceded <br />that between 1999 and 2004 he converted the carport to additional living space <br />without any building permits from the City. Exhibit 1, Staff Report, Page 3, <br />Exhibit 5, Permit and Utility Records, Pages 4 and 5, Testimony of Mr. Moreno. <br />14. EMC 19.38.040(A)(2) provides that a nonconforming structure which does not <br />meet the required setbacks of the zoning district may be expanded so long as the <br />expansion does not encroach any further into the required setback. Building <br />Number 1 is setback four feet from the side property line; therefore, any <br />expansion of the structure may not be any closer than four feet. The converted <br />carport is setback three feet from the side property line. The Appellant stated <br />that he did not expand the carport but merely utilized the same posts that were in <br />existence. The Appellant further asserted that the three feet measurement was <br />from the fence and the structure may conform to the required four foot setback. <br />Exhibit 1, Staff Report, Page 3; Exhibit 4, Site Plan; Testimony of Mr. Ingalsbe; <br />Testimony of Mr. Moreno. <br />Maximum Lot Coverage <br />15. EMC 19, Chapter 6, Table 6.1 states that the maximum lot coverage by buildings <br />within the R-2 zone is 40 percent. For a 6,000 square foot lot, the maximum <br />permitted coverage is 2,400 square feet. Exhibit 6, Pages 9 and 11. <br />16.According to Tax Assessor records, Building Number 1 is a one-story 2,882 <br />square foot basement structure and Building Number 2 is a one-story 466 square <br />foot structure. Based on the site plan submitted by the Appellant, the footprint of <br />Building Number 1 is approximately 2,174 square feet and the footprint of <br />Building Number '2 is approximately 532 square feet. The total footprint of both <br />buildings is approximately 2706 square feet or 45 percent of the total lot area. <br />Exhibit 6, Tax Records, Pages 9 and 11. <br />17. Building Number 1 was originally built in 1918. In 1966, the City permitted a <br />carport addition measuring 20 feet by 24 feet, or 480 square feet, for this <br />structure. Exhibit 5, Pages 4 and 5, Building Permit No. 4964 and Site Plan. <br />18. Building Number 2 was originally built in 1918. In 1979, the City permitted a <br />workshop addition measuring 12 feet by 14 feet, or 168 square feet, for this <br />structure. Exhibit 5, Pages 8 and 9, Building Permit No. 6739 and Site Plan. <br />19. The total coverage of the subject property was increased by a total of 648 square <br />feet, or 10.8 percent of the site, between 1966 and 1979.
