6 <br /> 4.0 Proposal Evaluation Criteria and Process <br /> 4.1 The City will evaluate proposals according to a number of relevant factors,anyone of which will <br /> suffice to determine which proposal is the most advantageous to the City and its citizens: <br /> • The ability, capacity and skill of the Proposer to timely respond to multiple,close-in-time or <br /> simultaneous requests for services within the proposed zone(s). <br /> • The Proposer's customer service capacity,ability and skill in making the process for recovery of <br /> vehicles accessible and convenient for vehicle owners, including ensuring the availability of staff to <br /> receive calls or arrange the release of vehicles,ensuring the owner's ability to recover their vehicles at <br /> the impound lot, and communicating effectively with owners about hours of operation,tow and storage <br /> rates. <br /> • The Proposer's customer service capacity, ability and skill with respect to accurate,courteous and <br /> timely communications with EPD. <br /> • The Proposer's compliance with state and local laws and regulations relating to tow operations, <br /> including,but not limited to,EMC 5.70.110. <br /> • The security features of the Proposer's impound lots and Proposer's demonstrated ability to keep <br /> vehicles secure while in impound. <br /> • Competitiveness of rates proposed by Proposer. <br /> • The character, integrity, reputation,judgment, experience and efficiency of the Proposer. <br /> • References regarding the quality of performance of previous public and private contracts or services, <br /> including,but not limited to,the Proposer's failure to perform satisfactorily or complete any written <br /> contract. The City's termination for default of a previous contract with a Proposer shall be deemed to <br /> be such a failure. <br /> • The previous and existing compliance by the Proposer with laws relating to the contract or services. <br /> • Evidence of collusion with any other Proposer, in which case colluding Proposers will be restricted <br /> from submitting further bids on the subject project or future tenders. <br /> • Whether the Proposer is not qualified for the work or to the full extent of the proposal. <br /> • Whether there is uncompleted work with the City or others,or an outstanding dispute on a previous or <br /> current contract that might hinder,negatively affect or prevent the prompt completion of the work <br /> proposed. <br /> • Whether the Proposer failed to settle bills for labor or materials on past or current public or private <br /> contracts. <br /> • Whether the Proposer has been convicted of a crime arising from a previous public contract,excepting <br /> convictions that have been pardoned, expunged, or annulled. <br /> • Whether the Proposer has been convicted of a crime of moral turpitude or any felony,excepting <br /> convictions that have been pardoned, expunged or annulled,whether in this state, in any other state,by <br /> -the United States, or in a foreign country,province or municipality. Proposers shall affirmatively <br /> disclose to the City all such convictions,especially of management personnel or the Proposer as an <br /> entity, prior to notice of award or execution of a contract,whichever comes first. Failure to make such <br /> affirmative disclosure shall be grounds, in the City's sole option and discretion, for termination for <br /> default subsequent to award or execution of the contract. <br /> • Whether more likely than not,the Proposer will be unable, financially or otherwise,to perform the <br /> work. <br /> • Whether, at the time of proposal opening,the Proposer is not authorized to do business in Washington, <br /> or otherwise lacks a necessary license,registration or permit. <br />
