1L <br /> Review Process IV applies only to permit applications for variances from the <br /> provisions of the zoning code that do not require any Review Process II or III permit or <br /> hearing examiner decision, including: <br /> A. Variance request; <br /> considered concurrently with a Review Process III use(EMC 19.31.070(A)(2)); <br /> C. Modification of approved site plan; <br /> • • <br /> Ch. 4 § 5(A), 200 <br /> 15.16.290 (RESERVED)Hearing. <br /> Review Process IV applications require an open public hearing before the board of <br /> adjustment. Public notice requirements are specified in Chapter 15.21 EMC. (Ord. 2530 <br /> 01, Ch. 4 § 5(B), 2001) <br /> 15.16.300 (RESERVED)Review criteria. <br /> Except as otherwise provided by this title, the board of adjustment shall review all <br /> requests for variances to the provisions of the zoning code. The decision of the board of adjustment to grant a variance <br /> shall become effective as of the date set forth in the order.
