Except as otherwise provided in this title or by <br /> state law, the city shall provide a notice of decision as specified in Chapter 15.24 EMC <br /> on all Review Process II and; III, and IV applications within one hundred twenty days <br /> after the city notifies the applicant that the application is complete. The city shall meet <br /> the accountability requirements of EMC 15.24.280 if a notice of decision is not issued <br /> within one hundred twenty days. <br /> Section 8. Section 3(A) of Chapter 5 of Ordinance No. 2530-01 (EMC 15.20.100), is <br /> hereby amended to read as follows: <br /> Exceptions. <br /> The time limit requiring a final decision within one hundred twenty days of the notice <br /> I of application on a Review Process II and; III, or IV decision does not apply if the land <br /> use permit application: <br /> A. Requires an amendment to the comprehensive plan or a development regulation; <br /> B. Requires approval of a new fully contained community as provided in RCW <br /> 36.70A.360, or the siting of an essential public facility as provided in RCW 36.70A.200; <br /> C. Is substantially revised by the applicant, in which case the new one-hundred- <br /> twenty-day time period shall start from the date at which the revised project application is <br /> determined to be complete; or <br /> D.
