3 <br /> 5.0 PROPOSAL EVALUATION CRITERIA <br /> 5.1 Evaluation Committee <br /> The City will establish an evaluation committee to review Proposals. The City Council <br /> shall select the preferred developer. <br /> 5.2 Factors Relevant to Evaluation <br /> Proposals will be reviewed and evaluated taking into account a number of factors: <br /> a. The Proposal's fit with the City's objectives and the Proposer's responsiveness to the <br /> RFP and to the RFP specifications; <br /> b. The demonstrated ability of the Proposer to implement the concept of the proposed <br /> development project; <br /> c. The competitiveness of the proposed purchase price for the Property; <br /> d. The demonstrated experience of the Proposer relevant to the accomplishment of the <br /> City's objectives; <br /> e. The demonstrated ability of the Proposer to independently finance and construct <br /> improvements; <br /> f. The character, integrity, reputation,judgment and efficiency of the Proposer; <br /> g. The Proposer's references relevant to the criteria in this section; and <br /> h. Whether the Proposal has failed to settle bills for labor or materials on past or current <br /> public or private contracts; and <br /> i. Whether the Proposer has been convicted of a crime arising from a previous public <br /> contract; and <br /> j. Whether the Proposer has been convicted of a crime of moral turpitude or any felony, <br /> excepting convictions that have been pardoned, expunged or annulled. <br /> Proposers must affirmatively disclose to the City all such convictions, especially of <br /> management personnel or the Proposer as an entity, prior to the execution of the <br /> agreement. Failure to make such affirmative disclosure shall be grounds in the City's <br /> sole discretion, for termination for default subsequent to any execution of an agreement. <br /> Everett Downtown Mixed-Use Development(Allen Buick/Culmback Property)-RFP Page 12 <br />
