ARTICLE 2 - NON-DISCRIMINATION <br /> The City agrees not to discriminate against any person or employee for his/her activity in behalf <br /> of or membership in the Union. The Union and the City agree not to engage in unlawful <br /> discrimination against any person or employee because of race, color, sex, creed, national <br /> origin, age, marital status, sexual orientation, or the presence of a physical or mental disability, <br /> unless it is a bona fide occupational qualification. <br /> The City and the Union, recognizing the need for affirmative action, do mutually agree to be <br /> supportive to the City's Affirmative Action Plan in striving to provide opportunities for meaningful <br /> employment of those persons or groups who have been victims of discrimination. The City's <br /> Affirmative Action Plan shall not change the existing bargaining Agreement or seniority rights of <br /> those employees covered by this Agreement. <br /> 2 <br />
