, <br /> � 1 CONSTRUCTION PHASING <br /> I 2 Description <br /> 3 The Contractor shall adhere to the construction phasing as shown on the plans and <br /> 4 outlined below. <br /> � 5 <br /> � 6 In Water Work Windows <br /> 7 In water work shall not occur between February 15 and July 15 of any year. <br /> 8 <br /> I9 For the protection of juvenile salmon, juvenile oull trout and bald eagles, all construction <br /> 10 work shall be subject to the following timing restrictions: <br /> � 11 General Provisions—Applicable During All Work <br /> 12 • Barges may not yrcund and anchors or spuds may not be placed in <br /> 13 eelgrass zone (0 f�aet MLLW to—16 feet MLLW). <br /> � 14 . Minimal power must be used while maneuvering barges near eelgrass <br /> 15 beds (0 feet MLLW tn—20 feet MLLW). <br /> 16 . No discharge of wet or uncured concrete or other debris to the water is <br /> 17 allow��d. <br /> I 18 . Monitors must verify that no marbled murcelets are present within 800 feet <br /> 19 of work site, prior to initiation o( impact pile driving and continue to <br /> 20 monitor ihroughout the duration o( impa�t pile driving. Impact pile driving <br /> � 2 i must be ceased immediately if marbled murcelets are seen within 800 feet <br /> 22 of the work area and may not resume until the birds have moved beyond <br /> 23 800 feet from the work area. No harassing oi this species is allowed. <br /> I 24 <br /> 25 Periods/Nature of Allowed In-water Work <br /> 26 • July 1 through July 15 — Work below ordinary high water (OHW) allowed <br /> � 27 in the dry only (landward of the water's edge). Allowed work does not <br /> 1 28 include impact driving of piles. No equipment is allowed on the beach. <br /> 29 • July 16 through July 31 — If no eagle fledglings remain in the nearby nest, <br /> � 30 impact pile driving is allowed, in the dry only. No equipment is allowed on <br /> 31 the beach. <br /> 32 • August 1 through October 15 — In-water worl:, inciuding impact driving of <br /> � 33 concrete piles, beach restoration, and vehicle movement on beach, <br /> 34 allowed with the following conditions: <br /> 35 o Eagles have fledged from nearby nest (expected by July 15, <br /> 36 based on 2004 observations). <br /> , 37 o Impact driving of steel piles in the dry is allowed. <br /> ' 3a • From Augusl 1 through September 15, impact pile driving may not start <br /> 39 until 2 hours afler svnrise and must end 2 hours before sunset. <br /> � 40 • October 15 through December 31 — In-water work, including impact <br /> 41 driving o( concrete piles and vehicle movement on beach, allowed with <br /> 42 the following conditions: <br /> � 43 o Weekly monitoring by a WDFW-certified forage fish technician <br /> 44 verifies that no forage fish spawn is present on beach. <br /> 45 o If no sand lance spawn is found, August 1 through October 15 <br /> � 46 conditions apply. <br /> 47 o I(sand lance spawn is found, no work or the beach, or pile driving <br /> 48 landward of—2 feet MLLW is allowed. <br /> I <br /> � <br /> Port of Everett FAWAT-03-039 <br /> Satellftc RaillBarge Transfer Facility Final Port Review Dra(t <br /> iPhase 1:Pier Constructlon 2 15 March 2005 <br />
