The implementation of Chis <br />mitigation plan is necessary in order that the goals and <br />policies of the Shoreline Acr_ are saCisfied. <br />16. The zonin3 restric�ions for the Agricultural Flood <br />Fringe Zone in which the properCy is located must be <br />salisfied. <br />DECIS�ON <br />Based upon t,he preceding Findings of Facts and Conclusions, the <br />tesCimony and evidence submiC+_ed at lhe public hearing, and <br />upon the impressions of the EvereCt Hearing Examiner of the <br />site view, it is hereby ordered �.hat the requested Shoreline <br />S�bslanCial Development Permi�, for lhe Cily of Everetk for the <br />consCruction of a lrickling filter!solids contacL mechanical <br />treatment plant and other i:nprovements as set f�clh in the <br />Introduction of t_his document are granted subject to the <br />following conditions: <br />1, The project musl be developed according to the site plan <br />altached to exhibil 9. �,11 mitigation measures as se�_ <br />forth in exhibiC 9 must be adhered to. <br />2. All outside dike faces shall be hydroseeded. All olher <br />vegeCation disturbed during construction musC be <br />replaced in kind. The City of Everett's Planni�g <br />Department is to inspect and approve all replanting of <br />vegetation disturbed during consCruction. <br />3. Detailed landscaping plans shall be reviewed and <br />approved by lhe Everett Planning Department prior t.o <br />issuance of any building permi�.s. These plans must show <br />planting details around all proposed huildings, the <br />hydroseed mixture proposed for lhe outside dike face and <br />the general treatmenl proposal for oCher areas disturbed <br />during consCruclion. <br />4. All utility services provided for the treatment plan�. <br />expansion shall be undergrounded. <br />5. All buildings shall be localed a minimum of 200 EeeC <br />landward of the ordinary high water mark and generally <br />as depicled on Exhibit #9. <br />6. Beyond fifteen (15) feet <br />shall be no lower than one <br />flocd protection elevation <br />for the Ayricullural Flood <br />f;om any structure the fill <br />(1) foo�_ below the regularory <br />. This is a zoning condirion <br />Fringe Zone. <br />
