FINDINGS AND CONCLUSIONS: <br />Criterion No. 1: <br />That the variance is necessary because of exceptional or extraordinary <br />circumstances regarding the size, shape, topography, or location of the subject <br />property; or the location o( a pre-existing improvement on the subject property <br />that conformed to tne zoning code in effect when the improvement was <br />constructed. <br />a. Findinqs: The proposed buil�iing is located at the City of Everett <br />sewage treatment (acilily. 1'he site is over 450 acres in size <br />however, it is surrounded on three sides by bodies of water, and also <br />contains severa; environmentally sensitive features. The entire <br />parcel is within the Rural Flood Fr'nge District designated as such <br />due to periodic flooding of the Snohomish P.iver, and therefore is <br />subject to addilional regulations of the Federal Flood Insurance <br />Program, as well as the Shoreline Master Flan. <br />The existing facility is the only one of ils kind within the Cily of <br />Everett. Much of the site is already occupied by approximately 190- <br />acres of wastewater treatment ponds which have dike elevations oi <br />approximately 3.48 feet. The seven-acre mechanical treatment <br />pror,�ss station and administration building are built on fill to provide <br />a finished floor elevation of approximately 16.62. <br />The area occupied by the mechanical treatment facility is unavailable <br />for the proposed building location due ?o a thirty million dollar <br />expansion proposed over the next couple of years for the treatment <br />processing facility. The areas surrounding the � jministration <br />building are limited in their development potential due to Shorel�ne <br />Jiirisdiction and irsuRicient buildinc� space, which leaves the area to <br />lhe east of the administration huilding the o�ily possible building <br />location within an exiting flood protection area. This area however is <br />limited in building siting by several factors, including: 1) a PUD <br />transformer and switch gear facility to the soulh: 2) a 54-inch sewer <br />influent line to the west; 3) an existing drainage swaie to the north <br />along 4'" Street SE; 4) site shape and layout of existing features. <br />AF�proximalely 5,700 cubic yards of fill will be used to elevate the <br />building a minimum of two feet above the 100-year (lood elevalion. <br />Seventy six (76) concrete piles wili support and anchor the building's <br />finished floor elevation to a 16.95 foot elevation, approximately 4.4 <br />fe�t above the 100-year flood elevation. All of the existing treatment <br />dikcs are at elevaiinns of approximately 8.48 (eet. The proposed <br />cuilding will comply with lhe requirement for all structures to be two <br />feet above the regulatory ilcod protecticn elevation. The proFosed <br />variance is for the land that lies beyond the structure, as well as the <br />driveway. <br />The siting of the new facility is limited to the proposed location based <br />upon existing site features, as well as existing and proposed <br />deve�opment tr�=nds cr site. <br />� <br />
