The City of Everett has recommended approval of the <br />rezone subject to the formation of a Concomitant <br />Agreement between the three individual property owners <br />of the lands within the subject property. <br />DECISION <br />Based upon the preceding Finding of Facts and Conclusions, the <br />testimony and evidence submitted at the public hearing and upon <br />the impressions of the Everett Hearing Examiner upon a site <br />view, it is hereby ordered that the requested rezone is granted <br />for the property located at the northwest corner •of Lenora and <br />South First Avenue in the City of Everett, Washington, and more <br />Particularly described as set forth above, be granted. The <br />rezone is for the 1.3 acres and is a change from a R-2, Single <br />Family High Density Residential designation, to a B-2, <br />Community Business designation. This rezone is effective <br />subject to the entry of a Concomitant Agreement between all of <br />the property owners and the City of Everett. A copy of the <br />proposed Concomitant Agreement for all three property owners is <br />attached hereto. <br />It is noted that there are changes from the original <br />Concomitant Agreements submitted at the public hearing. The <br />changes of the Concomitant Agreements made by the Everett <br />Hearing Examiner are: <br />Section ]. (F) shall read as follows: <br />F. The appearance of all commercial buildings will <br />generally conform to the historical theme portrayed by <br />the plans for the MTB 'office (Exhibit 5). A Design <br />Review Committee composed of the cwners of the subject <br />property, an independent architect, and a representative <br />of the Lowell Civic Association or its successor, shall <br />review all building plans for all st.uctures prior to <br />the submittal to the City to insure that they generally <br />conform to the design of MTB office building. <br />
