Diedrich; U20-84) <br />Based upon the �aritte❑ request for a variance from the City's zoning I <br />code, specifically EMC 19.16.030, made bq Dennis V. Diedrich, hereinafter <br />referred to as "Applicant," the IIoard of Adjustmeot held a public hearing on <br />said application o¢ September 10, 1984. Following said hearing, a motion vas <br />made and eeconded to grant the variance request. Board membera Wilson and <br />Zook voted for the granting of the variance �+hile board members Miller and <br />Hoagland voted againa[ granting the variance. The baeis for the board membersl <br />voting against the granting of the variance is as fol.locrs: <br />1, There are no exceptional or extraordinary circumatances or conditionsl <br />ap�rlying to the subject property or as to the intended use thereof, <br />that do not apply generally to ocher properties in the same vicinity or <br />zone: <br />a. <br />b. <br />Findinge: � <br />The Applicant � � s a parcel of property which ia located at 5512 <br />South Firet �t, Everett. The Applicant's property conaiats <br />of a-6,a 0 equare foot lot which le zoned R-Z• � 000 s uare <br />allovs ai.ngle family renidences to be located oa 5, q <br />foot lots and duplexes to be located on 7,500 ayunre foot lots <br />(EMC 19.16.030). The other lots in Applicant's block have single <br />family residences on Lhem. Applicant's property containa no <br />conditions such ae shape or topographical locatton vhich are <br />unique to hie lot. Applicant ie seeking a variance to allov a <br />duplex on a 6,000 aquare foot lots. <br />The Applicant hae a aingle family structure on the subject <br />property which has been converted to a triplex and lican[ rofnthe <br />being used as a duplex. The conversions by the App <br />structure in question toak place wlthout tVie required City <br />permita. <br />Conclusions: <br />The Applicant's property does not contain any phyeical conditiona <br />or circumstances unique to his property for which a variance can <br />be granted. Applicant�e current use is in violation of the <br />City's zoning code. The only harJahip which the applicant has <br />demonstrated is due to the fact that he now is operating a dupleA <br />atructure where such is not permltted unless t:he Applicant has � <br />lot of 7,500 square feet or largtr. :.�t this cannot be <br />considered an excep[1ona1 or extraordinary circumEtance becausE <br />the only reason the Applicant is in this 3ltuation ia that he haE <br />not complied vith the City ordinances.
