5a�� so. ��a . <br />COVENANT CONSENTING TO FOR�IATION <br />OF A LOCAL IMPROVEMENT DISTRICT <br />WHEREAS, ALLAN MAY and ELEANOR ANN MAY, husband and wife, <br />hereinafter referred to as "Owner," owns certain property within the City of <br />Ever tt legally described as follows: <br />r,�.^l ��tti✓L�F a��e��.E <br />�,�Lot� 3 and,�4, Block 17, Town of Lowell, according to the Plat <br />thereof, Records of the Snohomish County Auditor. <br />WHEREAS, Owner has applied for a permit from the City of Everett which <br />under Ordinance No. 555-78 nnd Ordinance No. 665-SO require certnin improve- <br />ments to be made to public rights of way as a condition to issuance of certnin City <br />permits; said Ordinances allow that thc City Engineer may aceept a covenant <br />consentin� to the formution of a local improvement distriet in lieu of having Owner <br />construct and install the required public improvements when, in the opinion of the <br />City Engineer, certain actual improvements are not desirable due to known or <br />perceived physical problems or the need For more comprehensive improvements; <br />�VHEREAS, Owner's property and the adjacent public riglits of wny have <br />been determined to require u covenant consenting to the formntion of a loc�l <br />improvement district rather than havinq Owner make specific improvements. <br />NOW, THERBFORE, in considerution of issuance of npplicuble City <br />permit(s) pursuant to Ordinance No. 555-78 and Ordinance No. 665-SO and in lieu <br />of certnin public right of wuy improvements Owner consents to Yhe formation of n <br />local improvement district hereafter formed by the City or its successors or other <br />property owners for the public improvement of: <br />South 3rd Avenue and the nlley west of South 3rd Avcnue <br />or a portion thereof including street improvements defined in Ordinnncc Nos. <br />555-78 nnd 6G5-80 to include: <br />The instnllation of nll public fncilities required to improve the street <br />to City design standards including grnding, drninage, pnvement, <br />curb,/gutter, sidewall<, strcet lights, traffic signals and othcr neces- <br />sary nppurtennnces. Such street improvements shnll not be limited to <br />the halt street ubutting the property; for exnmple, wherc no per- <br />mnnent strcet improvement existed, the strcet improvemcnt shall bc <br />extended beyon�? the centerline n sufficicnt distiince (10 ft. minimum) <br />to permit snfe rnovement of irnffic. <br />
