52/(� So . 3 �d , <br />COVENANT CONSENTING TO FORh1A1'ION <br />OF A LOCAL IMPROVEMENT DISTRICT <br />WHEREAS, ALLAN MAY and ELEANOR ANN MAY, husband and wife, <br />hereinaf:er referred to as "Owner," owns certain property within the City of <br />� Everqtt legally described as follows: <br />/ r <br />r^�^� �Jt�1VLc� alI e} l<�' <br />�1Lot�( 3 and,�4, Block 17, Town of Lowell, according to the Plat <br />thereof, Records of the Snohomish County Auditor. <br />WHEREAS, Owner has applied for a permit from the City of Everett which <br />under Ordinance No. 555-78 and Ordinance No. 665-80 require certnin improve- <br />ments to be made to public rights of way as a condition to issuance of certnin City <br />petmits; said Ordinances nllow that the City Engineer may accept a covenant <br />consenting to the formation of a local improvement district in lieu of having Owner <br />construct and install the required public improvements when, in the opinion of the <br />City Engineer, certain actual improvements are not desirable due to known or <br />perceived physical problems or the need for more comprehensive improvements; <br />{9HEREAS, Owner's property and the adjncent public rights of way have <br />been determi�;ed to require n covenant consenting to the formntion of a local <br />improvement dis:rict rather than having Owner make specific improvements. <br />NOW, THEREFORE, in considerntion of issuance of upplicable City <br />permit(s) pursuant to Ordinance No. 555-78 and Ordinance No. 665-80 and in lieu <br />of certain public right of wuy improvements Owner consents to the formatiun of n <br />local improvement district hereafter formed by the City or its successors or other <br />property owners for the public improveinent of: <br />South 3rd Avenue and the nlley west of South 3rd Avenue <br />or n portion thereof including street improvements defined in Ordinancc Nos. <br />555-78 nnd 665-80 to include: <br />1'he instnllation of nll public fncilities required to improve the street <br />to City design stnndnrds including grading, drninage, pnvement, <br />curb/gutter, sidewalk, strcet lights, traffic signnls nnd other neces- <br />sary appurtent�nces. Such street improvements shnll not be limited Lo <br />the half street abutting the property; for exnmple, tvhere no per- <br />mnnent strcet improvement existed, the strcet improvement shatl be <br />extended beyond the centerline a sufficient distance (10 ft. minimum) <br />to permit snfe movement ot truffic. <br />
