Doesn't <br />the same apply with other laws? <br />When I spoke with the Department of Fisheries, they expressed frustration with the City <br />for not holding to the buffer zone. They feel the City is too lax in controlling the building <br />around the streams and that attitude comes directly from your office. i sincerely hope <br />that is not true. <br />There are �wo beautiful big trees in the City right of way in front of this property. I am <br />now told that his permit allows him to take down these trees, if he wishes, and of course <br />he wishes because he is advertising his homes as havinc a view of the Cascades. <br />Again, no one has ever talked with us about this possibility. Those trees were planted, <br />with the City's Nermission, over twenty years ago by three of our daughters and the <br />mother of our neighbor. The two `amilies nurtured the trees until they now tower over <br />the houses. Our daughters grew up with them and until the construction, their chiidrer <br />played in them. This has been very traumatic for the children, young and older. <br />Couldn't someone have at least talked with us? We have trees on our property which <br />biock the view from some of his houses. Is he going to be given authority to cut them <br />down too. <br />I am told that another area of concern would take legislative action. The issue is the <br />ordinance that sets the hours for construction work. In all of the cities and towns where <br />I have had construction projects, the hours are usually seven or eight a.m. to five or six <br />in the evening. I feei that seven a. m. to ten p.m., the hours of work in Everett, is <br />unacceptable, especially in residential neighborhoods. How can children be expec;ed to <br />get up in the morning for school, when heavy equipment is operating until ten p.m. in the <br />lot next door? For that matter, how can adults function when they are disturbed until <br />that late? Citizens should be allowed some "down time" to watch television, read to their <br />children, or talk with friends, without the noise pollution of construction machinery. <br />Please ccnsider making a change to this ordinance, at least in residential areas. <br />I am only one individuai; however, i know I am not the only citizen with the above <br />feelings and concerns. I am not against progress. I am not against the building of new <br />homes. I am against misusing our natural resources. I am against government workers <br />who show favoritism to developers or adopt an atlitude of complacency. I am against <br />elected officials who allow the government to play favorites with no regard to the rights <br />and needs of other citizens. I hope you will respond to my concerns. I will be very <br />disappointed if you fit in the above category. <br />This letter will serve as o�cial notice to the City of Everett that if our property is <br />adversely affected by the City's approval of the work taking place on lots 1 through 7 <br />and 13 through 24 of Smiths 1st add to Lowell, Block 034 D-00 (West side of 5600 block <br />of South 3rd Avenue), including but not limited to the waiver of the waterw3y buffer, we <br />will hold the City of Everett liable. <br />SINCERELY, <br />C��T�^� ��,L�fl�� <br />Gladys Bismore <br />Cc: Everett City Council members <br />
