Finding: As proposed in the Wetland tiiitigation study, mitigation measures would <br />include the folio�ving: <br />• Wetland buffer enhancement (or the wetland on the abutting parcel to the north. <br />• Bu(fer enhancement would include removal of blackberry plants and plantir�g of <br />(ast-growing native plants, such as cedar, (ir, dogwood and red elderbsrry. <br />Conclusion: Adequate mitigation of project impacts can be provided. <br />III. ADDITIONAL FINDINGS ON TRANSFER OF DEVELOPMENT RIGHTS: <br />If the Cily determines that a reasonable economic use of the lot or lots cannot be <br />provided under Subseclions 37.050.8.3 of the Zoning Code, the City may authorize a <br />trans(er of development rights (TDR). A TDR may only occur afler review of a <br />reasonable use applicalion. TDR means that the Cily severs the development righls <br />from lhe (ee interest and permits the owner of the restricted parly to either transfer an <br />authorized nortion of the development rights in hat property to another lot owned by the <br />r�stricted party, or to sell an authorized portion of the righls to owners oF land who can <br />use such rights in accordance with Subsection 37.050.8.3 of tho 'Loning Code. <br />Subsection 37.150.8.3 of the Zoning Code describes the process for implementation of <br />TDRs. It is anticipated that Iha transfer Nrould be applied through the land use and <br />environmental revie�v of a proposed development on ihe receivin� property. <br />In lhis case the developmsnt credit for each of the (our parcels will be one credit, for a <br />lolal of four (4) TDR credits. The credits will authorize construction of up to four dwelling <br />unils eilher in the form oF single-family dwellings, or four units �vithin duplex, townhouse, <br />or multifamily slructures). This credit may be used for a receiving property that meets <br />the criteria in Eh1C Chapter 19.37.050.6.3. Please note that a formal land use decision <br />must be issued for development of a receiving property and implementation of the TDR <br />credits. This decieion does not constitute an approvai lo construct unils on any receiving <br />properly. <br />A TDR will resull in placement of an environmentally sensitive area covenant and deed <br />restriclion on future use of the original praperry. <br />IV. DECISION: The Planning Director hereby approves the requested reasonable use of <br />parcel No. 3-027 and Transfer of Development rights for the ren�aining four lots fronlin9 <br />on South 4'" StreeL The follo�ving conditions and limitations will apply: <br />The TDR shall consist of four residential dwelling units (single-family, du?lex, <br />lownhouse, or mulliple family) as permilted in Subseclion 39.150.6.3.c. <br />2. The TDR can oniy be implemented after review of a development proposal by the Gity. <br />3.
