4. An environmentally sensitive area prolective covenant for eac;� parcel must be submitted <br />to the Planning Department for raview and approval p-ior to issuanca of any <br />development permits for a site or sites �vhere the TDR creaits are to be applied. The <br />covenanls must be recorded on lhe tille of each lot and musi sever the development <br />rights for each parcel of the subject property consistent with the provisions of EMC <br />Ciiapter 19.37.050.6.3.c. The covenants must have a legal description for the entire lot <br />and restricted areas, and must have a parcel map atiached. <br />5. The soils study must be amended to a�{ �ress specific recommendations for grading, <br />foundation design, and drainage measw�s. The soils engineer must make inspections <br />during key phases of constructior,. <br />6. Prior to issuance of a buiiding permit for the duplex Parcel 3-027, tho applicant must <br />prepare a covenant running wilh the land which waives claims against the City, its <br />o(ficers, employees and agents, and indemnifies (including reasonable attorney's fees), <br />de(ends and saves the City, its officers, employees and agenls harmiess from any loss <br />or damage to people or property eilher on or off the subject property resulling from any <br />form of soil movement whatsoever and/or from any (onn of failure in design and/or <br />construction of the improvements thereon �vhalsoever. Tho o�vners of subject property <br />shall provide the Cily wilh the covenant and it shall be signed and acknowledged by all <br />parties with an interest in the property. The covenant sha:� also provide notice <br />concerning lhe presence of environmentally sensitive feaWre� on the property. The <br />covenant must be presented to the Cily Attorn�y for review and approval and, upon <br />approval, recorded by lhe applicant with the Snohomish County Auditor prior to issuance <br />of any construction permits. Please note that a standard form is available from the City. <br />Public Works Reauirements: <br />A Public Works Permit is required for lhis projecL Detailed drawings in accordance with <br />City Design and Construction Standards shall be submitled to the Public Works <br />Department, showing site parking layout, landscap�ng, utilities, storm drainage, <br />temporary construction erosion control, and all required improvements in the public <br />right-of-tivay. Pu61ic Wurks Department approval of these drawings is required prior to <br />any permits being issued. Ali improvements shali be compieted, approved and <br />warranted before the Occupancy Permit is issued/final approval is granted. <br />2. Parking must ba per City Zoning Code and City Design and Construction Standards for <br />Development. <br />3. In accordance with the City of Everelt Traffic Mitigation Ordinance, a Traffic Miligation <br />fee of $1,800.00 is required to be paid prior to the issuance of building permits. <br />4. Any gradingl(ill on this site shall be done so as to not impr .t the surrounding properties. <br />5. This project must comply with the current City of Everett Building Code and Sprinkler <br />Ordinance. <br />6. Lack of comment on the plans submilted with lhe application does not constitute <br />approval of these plans <br />7. Special charges for coi.neclion to the sewer and water systems in accordance wilh <br />Ordinance 1998-94 and subsequent revis' are applicable.
