<br />WE�itFAS, Ordinance No, 555-78 was enacted to reduce the adverse effect
<br />oE increased vehicle and pedestrian traffic on existing ne`._ahborhoods and
<br />provide safe and efficient facilities for vehicle and pedesl:rian traffic; and
<br />WE�REAS, Ordinance No. 555-78 requires, in part, a developer to improve
<br />street and alley rights rof-way; or at the discretion of the City Engineflr, a
<br />developer may convey and execute in the favor of the City of Everett an
<br />irrevocable power of attorney for the sole purpose of casting a wte, si9nit�g
<br />a petition or otherwise assen�ing to tlie formation of a Local Impmvetnent
<br />Distsict.
<br />NOW, TF�REFORE, in considerstion of issuance of a building permit�
<br />pursuant to Ordinance No. 555-78 and in lieu of certain required straet and/or
<br />alley i.mprovements, _ ��ja�y�!/,�hF.RMt:Tf-f
<br />reEerred to as "Developer"), and pursuat, to Ordinance No. 555-78, has made,
<br />constituted and appointed and by these presents does make, constitute and
<br />appoint the Ciiy as true and lawful attorney for it and in its name, placa
<br />and stead, and as an irrewcal.ile proxy to cast a wte for approval, by
<br />petition or otherwise, of any Local Improvement Distract hereafter formad by
<br />the City, �ts successor or other property owners in e benefit area encompassing
<br />£or ultimate street and related improvements pursuant �o Ordinance No. 555-78,
<br />as it presently exista or is hereafter amended or supplanted.
<br />This power of attorney shall be a conveyance of an irrevocable interest
<br />in and the Developer does by these presents convey to the City such limited
<br />interest in the foltowing described land, to wit:
