The existing structure is nonconforming as
to north side yard setbuck Which is five feet instead of the required six
feet front yard setback which is ;3 feet instead cf the required 20 feet and
lot size which is 4,50C sq. ft. instead of the required 7000 sq. ft.
The appl.icant has 2pplied for a Nonconforming Use Permit to allorr tte new
structure to be rebuilt on the footprint of the old structure on the north,
east 2nd west. The building aould be extended seven feet to the south wch
would not incre:.se the nonconformity of the building as related to front or
side aetbacks. A second story will be added, which along with the added seven
feet to the south will increase square footage of the re4idence from existing
1000 sq. ft. to 2360 sq. ft. (1480 sq, ft. on the first floor plus an 880
sq. ft. second floor). An existing 342 sq. ft. detached garage will remain,
tihich along With the proposed 2,360 sq. ft. residence totals 2,02 sq, ft, of
gross floor area. Dividing the 2,']02 sq. ft. by the 4,500 sq. ft. lot area
gives s gross floor area ratio of .60 instead of the .30 alloWed b+ code.
iFINDINGS AND CONCLUSICNS:

 1. That there have been exceptional or extraordinary circumstanees or
conditions applying to the sub, ject property or as to the intended use
thereof that do not apply generally to ottier properties in the same
vicinity or zone.
Finding: The house is on a nonconforming :ot of 4,500 sq. ft.
instead of the 7,000 aq. ft. required bp tha e w•rent code. The
applicant wishes to add a second story to take advantage of the view to
the west. The second story would be within the 35-foot height
permitted in the zone and it appears that it would not block anyone's
v1ew.
Conclusion: The size of the lot dietates the need for the v3riance.
 ..:"iar.r,l' J_`% i " nGrvr. .
+"i'Oi1G ___ I
t •
!:', ..
_. . .
•.. ..' . -.___ ✓UE
_-r
