16 <br /> 12. Testimony was received from a member of the public questioning the <br /> need for sidewalks on 76th Street. The City responded that it is not the <br /> Applicant's responsibility to develop the sidewaiks on 76th Street but <br /> that improvement would be required on Upper Ridge Road. (Taft <br /> testirr.ony, Tyler testimony) <br /> Jurisdktion: The Hearing Examiner of the City of Everett has junsdicfional <br /> authority to hold a heanng and to issue the decision. That authonty is set forth <br /> in EMC 2.23.020. Based on the above findings, the Heanng Examiner enters <br /> the lollowing conclusions: <br /> CONCLUSIONS <br /> 1. On September 13, 1995, the City of Everett approved a Resolution of <br /> Intent to Rezone and a Performance Agreement for the develop�ant of <br /> a PRD on property located at 7627 Upper Ridge Road, Everett, <br /> Washington. The approval allowed construction of 13 new single-family <br /> dwellings for elderly low income and disabled•persons. <br /> In 1996, the Applicant requested revisions to the approved site plan. <br /> The revisions included a change in house sryles, setbacks, traffic <br /> circulation, and open space. Subsequent to a public hearing, the <br /> amended site plan was issued on August 7, 1996. (Finding 1) <br /> 2. In order for a F'RD to he approved or amended, the criteria of EM11C <br /> 19.32.030 must be satisfied. Those criteria are satisfied by the <br /> proposal. (Findings 5, 7, 10) <br /> 3. The amendeo PRD will be located to provide dired access to the project <br /> and not create unacceptable volumes o� tra�c on local streets in the <br /> neighborhood. With the payment of tha mitigation fee of$4,480, <br /> adverse traffic impacts resulting from the proposed development will be <br /> eliminated. (Finding 6) <br /> 4. The density inu'ease of one unit is within the standards as allowed by <br /> the R-1 zoning designation within the City of Everett and the Single- <br /> Family Detached, Five to Ten Dwelling Units Per Gross Aue <br /> desigrration of the Everett Comprehensive Plan. (Finding 2) <br /> 5. The Applicar�t will provide parking that satisfies City of Everett <br /> standards. (Finding 9) <br /> 5 <br /> 62 <br />
