I. The estimated/actual cost of construction of the Utility shown in Exhibit A <br /> amounts to $ � � , 34$. (y4 which is a reasonuble cost for said constructio� and of which <br /> $ S(v-1 z.8Z shall be charged to the "benefited property" as a fair pro r�!a share of the <br /> cost of construction. The City finds that the "benefited property" has receivcd benefiu in <br /> the amount of the said fair pro rata shaze charged thereto. <br /> J. The City and the Owner desire and intend by this Agreement to provide for <br /> collection of a fair pro rata share of the cost of construction of the udlity from the owners of <br /> the benefited property (as described in Paragruph H above and shown in Exhibit A) who did <br /> not contribute to the original cost thereof under the provisions of the Municipal Water and <br /> Sewer Facilities Act, RCW 35.91.010 et seq.; provided, that nothing contained herein shall <br /> be construed to affect or impair in any manner the right of the City to regulate the use of its <br /> water system of which the Utility described in Exhibit A shall become a part under the <br /> terms of this contract. <br /> NOW, THEREFO.ttE, in cousideration of the mutual covenanis and agreements set <br /> forth, the parties agree as follows: <br /> 1. All of the recitals set forth abovc are adopted by the parties as material elements <br /> and/or findings related to this agreement. <br /> 2. The owner may be reimbursed by owners of the benefited prop�rty for portions of <br /> the cost to the owner of certain facilities, herein referred to as the utility installed by the <br /> owner when such faciliUes are in the future connected to such benefited properties. <br /> 3.
