4. The Utiliry has been or will be constructed to meet all standarc�s of the City's <br /> Public Works Department. <br /> 5. If the Udlity is certified as acceptable to the City by the Public Works Department, <br /> the Owner will convey the Utility and the easements and lands wherein it lies to the City. <br /> The City will thereafter operate the Utility as part of the City system and wlll charge normal <br /> connection fees and use charges. � <br /> 6. The Owner shall transfer tide free and clear of all encumbrances, to the Utility <br /> described in Exhibit A by a Bill of�ale to be executed and deliver. : by Owner to the City <br /> upon acceptance of said utiliry for maintenance by the City, which instrument shall contain <br /> Owner's wananh� that it has good title and the right tn canvey said Utility and that it will <br /> warrant and defend the City against the claim of interesf therein asserted by any third <br /> person, that it will guarantee the worlananship and materials in said Utility for a period of <br /> one year after date of acceptance by the City, and that it warrants said Utility to be fit for <br /> the use for which it is intended. <br /> Owner shall warrant that it is the owner in tiUe absolute of the Utility shown in <br /> Exhibit A and that it has neither permitted or suffered any person or other entity to tap onto <br /> or con,�ect to said Utility prior to the date of this Agreement. <br /> Owner shall further warrant that there are no pe:sons, firms, or corporations who have <br /> filed ur have th; right to file a lien against said Utiliry pursuant to the provisions of TiUe 60 <br /> of the Revised Code of Washington other than those heretofore filed which have been <br /> satisfied.
