That if the owners of benefited property dcscribed in Paragraph H above should later seek to connect their lands to or make use of the Utility the City shall not permit t6em to connect until the owners thereof have paid in cash to the City in addition to the regular connection cha�ges, a "latecomer fee", tl�at is, a charge equal to the pro rata cost of the Udlity as computed on a lineal foot basis and using actual cosu of construction. The parties hereto agree that the azea to be ber.efited by the Utility, amounts to �VO building sites of which OY1G building sites(s) is/are directly attributable to the Owner, the remaining is attributable to the benefited property and that the fair pro rata share of the cosu of construction of said Utility to be collected from the owners of the benefited property as described in Paragraph H above who tap onto or connect to said system shall be �+ 5�o7Z$Z per building site. 8. That the provision herein for reimbursement relates to costs of the Utility only. No reimbursement shall be made to Owner for the cost of local lines serving only his property. 9. The City shal! never be liable under [his Agreement or otherwise to pay any of the costs ef the Utility refened to herein. Owner agrees to release and waive any claims for any liability of the City in establishment and enforcement of this Agreement. The City's function herein is simply to compute and receive the latecomer fees and to transmit the same to the Ov,�ner; all such fees shall be paid without computation of any interest; fees of less than $25 need not be collected or transmitted. The Ciry shall pay the Owner the sum agreed by it to be collected pursuant to the provisions of the precedin�; paragraph, within sixty (60) days after receipt thereof at the address of die Owner as set forth hereinafter or at svch other addresses as the owner shall provide by certified mail.
