HTL <br />AUG 1 1991 <br />BOARD of CITY OF EVERETT <br />ADJUSTMENT Public Works Dept. <br />FINDIN 7, CONCLUSIONS, AND ORDER VARIANCE #18-91 <br />Based upon the written request for a variance from the City's Zoning <br />Code by: <br />Applicant: Kathleen Banks <br />1606 Virginia <br />Everett, WA 98201 <br />Location of Property: 1606 Virginia Avenue <br />Zoning: R-2, Single Family Residential <br />hereinafter referred to as "Applicant," for a variance from Section <br />9, requiring a minimum setback of five feet from the side property <br />line. The existing garage is proposed to be reconstructed on the <br />original footprint with a 8 foot expansion to the east, maintaining <br />the existing side yard setback of two feet on the south property <br />line. <br />FINDINGS AND CONCLUSIONS: <br />Criterion No. 1: <br />That the variance is necessary because of exceptional or ex- <br />traordinary circumstances regarding the size, shape, topography, or <br />location of the subject property; or the location of a pre-existing <br />improvement on the subject property that conformed to the zoning <br />code in effect when the improvement was constructed. <br />a. Findings- The Snohomish County assessor's records show the <br />existing house was built in 1930 although the assessors <br />records did not list the date of construction for the detached <br />garage separately it is assumed that it too was constructed <br />about the same time. The garage is approximately two feet <br />from the side property line to the south. <br />b. Ccnclncionce There are exceptional or extraordinary <br />circumstances regarding the location of a pre-existing <br />improvement on the subject property that conformed to the <br />zoning code in effect when the improvement was constructed. <br />
