ln 190 the beauty shop was changed to ihe
presant ue, which is the "Children's Attic" a
second hznd children's clothing store, vhere
children's clothing is sold on consignment.
When the Applicant applied for a business
license the City became aware that the parkinq
requirement vas not beinq met.
The parking requirement for this use is Lor a
total of eight spaces, three for the residen-
tial uae and fivc for the retail use.
It has 6eer City policy to allow credit for a
previous nonr.on.ormity in calculeting 'le
parking requirement when a use changes, so be-
cause o[ the previous use's nonconformity of
three spaces, the total parkinq requirement
for the Chi3iren's Attic and ^.vo apartment
units would be five spaces.
The Applicant i proposing to conscruct tWo
additional off-street parkir,q spaces south of
the building vhich will then have a Cotal of
four off-street parking spaces vhich is one
less tlian required. Decausr of the small ize
of the lot (],000 square feet) in relationship
to the size of the building (7,120 square
feet), there is no space on the site to pro-
vide additional parking.
Most of the customers of the Children's Attic
live in the neiqhborhood and so most o: the
traffic is "walk in" by residents of the area.
ri.LsSION:. There are unueual and extraordinary circum-
stances applying to the property and to the
proposed use of the property because of the
fact thet it is a nonconforming use and build-
ing in existence since the early 15o0's and
becaueie the intensity of use is less than the
usual retail se.
CRiTT+uION NO 2 FOIYavIAll-E:
That such variance ie necessery for the preservation end enjoy-
ent of a aubatential property right af the appellant possessed
by the ovners of other propertiea in the see vicinity or zono.
IM(4: There are other nonconforming uses in the vi-
cinity and zone that do not provide parking to
code.
rnwrr.ncION: Granting this variance is necessary in order
for the Applicant to enjoy a substantial prop-
erty right enjoyed by others in this vicinity
and zone.
CRITT'QION NO POR VARIl1{P,
That the authorizaticn of such variance vil] not be materia:ly
detrisental to the pvblic velfare or injurious to property in
the vicinity or zone in vhich the property is locnted.
PINDZNCS: The building has been in existence since 1919
and so is a fir.ture in the neighborhood ':hat
all ro_sidents were aware of when purchasinq
