Io CdC D
W
MdR 1 3 1999
_ .... ........... ........ _
CITY OF EVERETT
BOARD OF ADJUST1iENT Public Works Ucpt.
FINDINGS, CONCLUSIONS, WJD ORDER
Vd,RIN(CE NO. 3-89
Based pn the written request for a variance from the City's
zoning cude by:
Dean Lozano
2312 19th St.
Everet:, WA 98201
hereinafter referred to as "Applicant", for a variance from
E.M.C. 19.40.020, Off-Street Parking to allow less than the eight
off-street parking spaces required by code for a nonconforminq
use in a nonconforming building.
Location of Proposal.: 1902 Virginia
The Board of Adjustment, following a public hearing on said ap-
plication held on March 6, 1989, and further havinq reviewed all
testimony, makes the followinq Findings, Conclusions and Order:
,1 . , I k . ,
y: a: I;C#
That there have been exceptional or extraordinary circustances
or conditions applyinq to the subject property or as ta the in-
tended use thereof that do not apply generally tc other
properties in the sae vicinity or zone
FINDING: The property consists of a 3,120 square foot,
two-story, flat roofed, existing commercial
structure constructed in the early 1900's as a
grocery store on a 3000 square: foot lot. The
building was later remodeled, adding an
apartment on the second floor and one on the
first floor, leaving 770 square feet for the
grocery on the first floor.
In 1961 the grocery store was coflverted to a
beauty shop. The beauty shop use was a less
intensive use than the grocery store since it
was a one person shop and the parkinq require-
ment would have been for a total of five
spaces, three for the residential use and two
for the beauty shop. Since there were only
two off-street parking spaces on the site, the
parking was nonconforming by three spaces.
In 1987 the beauty shop was changed to the
present use, which i.s the "Children's Attic" a
second hand children's clothing store, where
children's clothing is sold on consignment.
When the Applicant applied Por a business
license the City became aware that the parking
requirement was not being met.
The parking requirement for this use is for a
total of eight spaces, three for the residen-
tial use and five for the retail use.
It has been City policy :.o allow credit for a
previous nonconformity in calculating the
parking requirement when a use changes, so be-
cause of the previous use's nonconformity of
three spaces, the total parking requirement
for the Children's Attic and two apartment
units would be five spaces.
