The Applicant is proposing to construct two <br />additianal off-street parking spaces south of <br />the building which will then have a total of <br />four off-street parking spaces which is one <br />less than required. Because of the �mall size <br />of the lot (3,000 square feet) in relationship <br />to the size of the building (3,120 square <br />feet), there is no space on the site to pro- <br />vide additional parking. <br />Most of the customers of the Children's Attic <br />1?.ve in the neighborhood and so most of the <br />traffic is "walk in" by residents of the area. <br />CONCLUSION: There are unusual and extraordinary circum- <br />stances applying to the property and to the <br />proposed use of the property because of the <br />fact that it is a nonconforming 4se and build- <br />ing in existence since the early 1900's and <br />because the intensity of use is less than the <br />usual retail use. <br />�J' . Y �+' • . � � <br />That �uch variance is ncscessary for the preservation and enjoy- <br />sent of a substantia� property riqht of the appellant possessed <br />by the ovners of other properties in the sa�e vicinity or zone. <br />FINDING: There are other nonconforming uses in the vi- <br />cinity and zone that do not provide parking to <br />code. <br />COIiCLDSION: Granting this variance is necessary in order <br />for the Applicant to �njoy a substantial prop- <br />erty right enjoyed by others in tl�is vicinity <br />and zone. <br />«• a• ., ,. <br />That the authorization of such variance will not be saterially <br />detrf�ental to the public velfare or injurioLs to property in <br />the vicinity or zone in which the property is located. <br />FINDINGS: The building has been in existence since 1919 <br />and ,o is a fixture in the neighborhood that <br />all residents were aware of when purchasing <br />their property. The surrounding area consists <br />of older, well maintained single family struc- <br />tures that appear to have the potential for <br />continuing in the same type of use for many <br />years, so major changes are not anticipated in <br />this neigriborhood in the near future. <br />No adverse comments have been received in re- <br />sponse to notice sent to property owners <br />within 300 feet of the project site and no ad- <br />verse comments have been received from other <br />city departments. <br />The Children' Attic provides a service to the <br />area by providinq low cost children'� clothing <br />and also "penny" candy to the children of the <br />neighborhood. <br />CONCLUSION: It does not appear that the authorization of <br />this variance would be materially detrimental <br />to the public welfare or injurious to property <br />in the vicinity and zone. <br />see <br />
