Conclusion: There are unusual circumstances applying to <br />the subject property since the lot is nonconforming for <br />width, and also because uf the SO foot width of the <br />abutting street which leaves an un�sual amo�nt of unused <br />right of way. <br />•1 .• <br />That such variance is necessary for the preservation and en- <br />joyment of a substantial property right of the appellant pos <br />sessed by the owners of other properties in the same vicinity or <br />zone. <br />a, �ndina: There are many other homes in the north end <br />that do not meet the ten foot side setback for corner <br />lots and many of the streets have a qreat deal of unused <br />right of way that is used as yard area by the adjoining <br />property. <br />b. Conclusion: Granting this variance would give the <br />applicant a property right enjoyed by others in the <br />vicinity and zone. <br />CiltPrinn NO. 3:_ <br />That the <br />detrimental <br />vicinity or <br />authorization of such variance will not be materially <br />to the public welfare or injurio�s to property in the <br />zone in which the property is located. <br />a. F�nd�na: If this variance is granted, the subject <br />property would still have yard areas similar to others in <br />this vicinity and zone. This is not a view area so there <br />is no potential for view blockage. <br />b. C�g�c��s�on: Granting this variance would not be <br />'_njurious to other property in the vicinity and zone. <br />Criter�on No. 4• <br />That the granting of such variance will not adversely affect the <br />Comprehensive General Plan. <br />a. F�ndina' The Comprehensive Plan designat�on is single <br />fsmily and the proposed use is single family. <br />b. Conclusion: Granting this variance would not �idversely <br />affect the Comprehensive Plan. <br />RECOfiENDATION : <br />APPROVE the variance as requested by applicant with the fol:nwing <br />conditions. <br />1.
