BOARD OF AI�TIISTlfENT <br />FINDINGS, CONCLUSIONS AND ORDER VAP.IANCE ti0. 38-88 <br />Based upon the written request for a variance from the City's <br />zoning code by: <br />James DeGroot <br />3005 Hoyt <br />Everett, WA 90201 <br />hereinafter referred to as "Applicant," for a variance from E.M.C. <br />19.42.040 (A), Yards, to allow a five foot side setback on the <br />north side instead of the ten foot required by code for a corner <br />lut. <br />on the following described property: <br />Lot 1 and the north half of Lot 2, Blk. 416, Capital Hill <br />_ Addition <br />commonly known as: <br />2001 Virginia <br />The Board of Adjustment, following a public hearing on said <br />application held on December 5, 1988, and further having reviewed <br />all testimony, makes the following Findings, Conc.`_usions and <br />Order: <br />FINDINGS AND CONCLUSIONS: <br />Criterion No. 1• <br />That there have been exceptional or extraordinary circumstances <br />or conditions applying to the subject property or as to the in- <br />tended use thereof that do not apply generally to other <br />properties in the same vicinity or zone. <br />a. Findina: The subject lot is nonconforming for width <br />since it is 37.5 feet wide and code requirement for lot <br />width in the R-2 zone is 50 feet. The Applicant is <br />proposing to build a single family structure that would <br />be five feet or more from the north corner side lot line <br />instead of the ten feet required by code. <br />There previously existed on the site a single family <br />residence that was built in 1922. That structure burned <br />down a year and a half ago, and was nonconforming for side <br />yard setback. There is no existing foundation; however, <br />there is a remdining cement front porch and steps that is <br />approximately five feet from the north property line. <br />This will be removed. <br />If the 10 foot setback were met, the applicant would only <br />be able to build a 22 foot wide house. He wishes to build <br />a 26 feet wide, 1248 square foot house with an attached <br />two car garage, which would be more in keeping with other <br />homes in the neighborhood. <br />Twentieth Street, which abuts the property to tl:e north, <br />has an eighty foot right of way but only approximately 24 <br />feet of paving plus the sidewalk so there is a great deal <br />of unused right of way that is in lawn, so there would <br />still be approxinately eleven feet of lawn between the <br />house and the sidewalk. Public Works has no plans to widen <br />Twentieth Street. <br />b. �onclusion: There are unusual circumstances applying to <br />the subject property since the lot is nonconforming for <br />width, and also because of the 80 foot width of the <br />abutting street which leaves an unusual amount of unused <br />right of way. <br />
