•� �• <br />That such variance is necessary for the preservation and en- <br />joyment of a substantial property right of the appellant pos <br />sessed by the owners of other properties in the same vicinity or <br />zone. <br />a. Findina: There are many other homes in the north end <br />that do not meet the ten foot side setback for corner <br />lots and many of the streets have a great deal of unused <br />right of way that is used as yard area by the adjoining <br />property. <br />b. Cottclusion: Granting this variance would give the <br />applicant a property right enjoyed by others in the <br />vicinity and zone. <br />_ Criteiion No. 3: <br />That the authorization of such variance will not be materially <br />detrimental to the public welfare or injurious to property in the <br />vicinity or zone in which the property is located. <br />a. Findina: If this variance is granted, the ��ubject <br />property would still have yard areas similar to others in <br />this vicinity and zone. This is not a view area so there <br />is no potential for view blockage. <br />b. Conclusion: Granting this variance would not be <br />injurious to other property in the vicinity and zone. <br />That the granting of such variance will not adversely affect the <br />Comprehensive General Plan. <br />a. Findina: The Comprehensive Plan designation is single <br />family and the proposed use is single family. <br />b. Conclusion: Granting this variance would not adversely <br />affect the Compretiensive Plan. <br />NOW, THEREFORE, the Board of Adjustment of the City of Everett <br />does hereby order that the variance as requested by the Applicant <br />be GRANTED, and further require the applicant to meet the <br />following conditions. <br />1. Obtain all necessary permits. <br />The action of the Board of Adjustment in GRANTING a variance <br />shall be final and conclusive, unless within fifteen (15) days <br />from the date of issuance and signing of this order by the <br />Chairman of the Board, an aggrieved person or persons obtains a <br />writ of certiorari from the Superior Ccurt of Washington for <br />Snohomish County for the purpose of review of the action taken. <br />DATED this day c <br />� � <br />�:uii% ; ',.C��,_ <br />Chairman, ioard of Adjustment <br />, 1988. <br />
