7. Memo to Hearing Examiner from Don Wood dated 2/10/98 <br />8. Letter to Hearing Examiner from GRC Homes, Inc. dated 2/9/S8 <br />All of the exhibits are available for inspection at the Hearing Examiner's Office <br />located at 2930 Wetmore Avenue, 8th floor, Everett, Washington. <br />After due consideration of the testimony and evidence presented by the <br />Applicant, testimony and evidence elicited during the public hearing, and as the <br />result of the personal inspection of the subject property and surrounding areas <br />by the Everett Hearing Examiner, the following findings of fact and conclusions <br />constitute the basis of the decision of the Everett Hearing Examiner. <br />ji;IlZI 11*K61AiU1i1 <br />The Applicant requested approval of the certification of an 11,853 square <br />foot tax lot. It is the intent of the Applicant to develop the subject <br />property with a single-family residence. (Exhibit 1) <br />2. Admitted at the public hearing as exhibit 4 was a reduced copy of a site <br />plan. The subject property is depicted in the site plan as Parcel B. It is <br />the intent of the Applicant to develop Parcel B as a lot that has a single- <br />family residence. A copy of the reduced site plan is attached hereto and <br />by this reference is incorporated as part of these findings. <br />3. The tax lot was created with a Statutory Warranty Deed on August 24, <br />1978. The Melum and Smith Construction Company deeded the subject <br />property to John and Irma Bode (August 24, 1978). The Bode's later <br />resold the property to Susan Kutches (January 25, 1990) with a <br />Statutory Warranty Deed. Ms. Kutches sold the property to the Applicant <br />on August 19, 1997, via a Statutory Warranty Deed. (Exhibit 3) <br />4. Pursuant to a request issued by the Hearing Examiner, the Applicant <br />supplemented the record with a statement that GRC Homes, Inc. had no <br />involvement in any transactions of the subject property prior to early fall. <br />The Applicant appears to be an innocent purchaser of the lot. (Exhibit 8) <br />5. The lot satisfies all R-1 zoning requirements, including square footage <br />and setback standards. The subject property is an 11,853 square foot <br />parcel. Access to the lot is provided through a 15 foot easement over lot <br />6 of the Younce Addition. This access satisfies the minimum access <br />requirements pursuant to the City Subdivision Ordinance. (Exhibit 1) <br />6. No opposition testimony was received at the public hearing. <br />2 <br />
