udsdkdOn. The Hearing Examiner of the City of Everett has jurisdictional authority to hold a hearing and to issue the decision. That authority is set forth in EMC 2.23.120. Based on the above findings, the Hearing Examiner enters the following conclusions: CONCLUSIONS 1. The Applicant requested approval of r -e certification of an 11,853 square foot tax lot. It is the intent of the Applicant to develop the subject property with a single-family residence. (Finding 1) 2. Tax segregated lots are certified pursuant to the requirements of EMC 18.28.010. The lots to be createc by tax segregation should be created prior to November 2, 1975. Although the lot in question was created subsequent to November 2, 197% the Applicant submitted documentation that it is an innocent purchaser of the Ict. Further, it satisfies all zoning requirements, with the exception of it being certifieti. In light of this documentation and the fact that the lot is unusable unless certified, an exception to the provisions of EMC 18.28.010 appear to be warranted. The access to the lot is via a legal access and all R-1 zoning requirements are satisfied. It is in the public interest that the lot be certified so that it can be developed consistent with the R-1 standards. To deny the certification would result in a situation contrary to the Growth Management Policies for infilling and the public interest in providing additional housing for the City of Everett. It is for these reasons that the tax segregated pot of the Applicant will be approved. DECISION Based upon the preceding findings of fact and conclusions, testimony and evidence submitted at the public hearing, and upon the Impressions of the Hearing Examiner at a site view, it is hereby ordered that for the reasons as set forth in Conclusion 2, the certification of the 11,853 square foot tax lot at 4913 Vista Place, Everett, Washington, is granted. The grant of this tax certification lot and the reasons for it are unique to the specific request. This does not, in any way, set a precedent for other tax certification lots in Everett.
