STAFF REPORT TO HOARD OF ADJUSTMENT
VARIANCE #26-85
February 21, 1986
Applicant: Dale Good
4712 West View Drive
Everett, WA 98203
Location of Property:
4712 West View Drive
Requested Action:
To obtair. a variance to allow a double
car garage to remain that is five feet
six inches from the side property line on
the southwest corner and angles to five
feet two inches from the sido property
line on the southeast corner instead of
the six feet sideyard required by
E.M.C. 19.14.050(B). In addition, the
eaves of the structures would extend to
within two feet, eight and one-half
inches of the side lot line instead of
the three and one-half feet required by
EMC 19.42.040(C).
Existing Zoning:
R-1, Single Family Low Density Residential
Existing Land Use:
Single Family with attached garage
Adjacent Land Use/Zoning:
North: Single Family/R-1
South: Single Family/R-1
East: Single Family/R-1
West: Vacant/R-1
Exhibits:
1. Vicinity/Zoning Map
2. Site Pldn
3. Narrative Statement
4. Survey
FINDINGS AND CONCLUSIONS:
That there have been exceptional or extraordinary circumstances or
conditions applying to the subject property or as to the intended use
thereof that do not apply generally to other properties in the same
vicinity or zone.
Findin The existing house was constructed prior to annexation to the
City, and County requirements at that time called for a five foot
sideyard setback. The house is not square or. the lot so by extending
the sidewall parallel to the existing house wall to enclose the
carport, it put the front corner of the garage ten inches into the six
foot setback area.
Conclusion: The setback of the house is legal since it is
nonconforming and if the house had been constructed squarely on the
lot, the extension of the wall to enclose the carport would not have
intruded further into the setback area.
z
0
—i
Mm
