The Appellant eubmitted that he has decided to build a home on the 3,000 <br />square foot lot, the subject property. He t�as had the property eurveyed <br />and hae purchaaed all of the materials ia anticipation of the <br />development. However, becauee the lot hae not been certified, he is nov <br />precluded from the development of thia lot. <br />12. The Appellant suhmitted varioue lettere of endoreement that have been <br />admitted as eahibite in this matter. He contended that the Appellant ie <br />preaerving the neighborhood through quality �ork. Ne suEmitted that he eupporta <br />the appeal. <br />CONCLUSIONS <br />1. The appeal ie of a City of Everett Planning Department's adminlstrative <br />denial of a vacant lot north of 2324 Walnut Street, Everett, Waehington, <br />ae beiag a certifiable lot oa which a aingle family dwelling could be <br />built. <br />2. <br />3. <br />4. <br />5 <br />The subject property is a eubatandard lot aubject to the provisione of <br />ElAC 19.56.110.B. <br />The two subatandard lota, including the eubject property aad the <br />adjacent property, srere acquired by common conveyance prior to December <br />1, 1956. <br />Neither of the two lota do meet minimum zoning requiremente and, <br />eherefore, have merged and are conaidered to be a aiagle uodivided lot. <br />The two lots must be conaidered as one lot. Theq cannot be individually <br />be used, altered, or sold in a manner that diminishes compliance rrith <br />lot area aad width requiremeats of R-2 zoned properties. <br />DECISION <br />Based upon the preceding findings of facts and conclusione, the testimony and <br />evidence su6mitted at the public heariag and upon the impreesione of the <br />Everett Hearing Ezaminer of the site view, it is hereby ordered that the <br />Everett Plaaning Department's decisioa to deay certificatiou of a vacant lot <br />north 2324 Walnut Street, Everett, Waehington, se a buildable lot is upheld. <br />
