Soard of Adjustment Minutes <br /> October 6, 1986 <br /> Page 9 <br /> Pearl Maddy suvmiarized the staff report (see Variance File Clo. 39-86) and <br /> presented slides of the property. <br /> Dale Lyski, the applicant and prooerty owner of 1430 Rucker, stated that this <br /> addition would substantially improve the appearance of the buildinq and would <br /> substantially modernize the house's 1936 kitchen. <br /> Motion: Ross Hoagland offered a motion to grant the variance as recommended <br /> by Staff, inasmuch as this addition will improve both the house and <br /> the neighborhood. Frank Bennett seconded the motion. <br /> Vote: Unanimous in favor of grantinq the variance. <br /> ITEti 6: <br /> Applicant: Robert La Grandeur <br /> 1213 Wetmore <br /> Everett, Washington 98201 <br /> Project Location: Lot 11, Plat of Nassau View Tracts <br /> Zonin : R-1 <br /> Variance Requested: Variance from E.M.C. 10.14.050(B) , Side Yards, to allow <br /> a zero-foot side yard on the north side where the property <br /> abuts unused public right-of-way. <br /> Pearl Maddy sunmiarized the staff report (see Variance File No. 40-86) and <br /> presented slides of the property. <br /> Pearl reported that she had received a phone caJ.l that afternoon from the person <br /> who own� the property to the north of this property. He is concerned because <br /> he was going to propose that the rest of the City ROW should be vacated. He <br /> hoped that tn=. vacated right-of-way would accrve to his property rather than � <br /> to Lot 11 �ince Lot 11 has already benefitted from some vacated right-of-way. <br /> However, this is a legal matter which this Board cannot address. In order <br /> for a street vacation to occur, 75$ of the abutting property owners must agree <br /> to the vacation. According to the City's property manager, approximately 50 feet <br /> of right-of-way abuts the property and wou'.d be eli.gible for vacation. About <br /> 20 feet of right-of-way was vacated and accrued to the subdivision at the time <br /> of subdivision. This area is steep and the City has no plans for a street there. <br /> Robert La Grandeur, the applicant of 1213 Wetinore, stated that this information <br /> concerning a possible street vacation was new to him, and that he was not aware <br /> that a previous vacation had accrued to the plat. <br /> Bill Lucas of 4002 Nassau Place, who lives directly across the street, stated <br /> that he has known Mr. La Grandeur for many years and he would make a good <br /> neighbor. He £eels the right-of-way would never be used. He favors the <br /> variance but he wants Mr. La Grandeur to remember that 15 feet is 15 feet. <br /> Burl Long, of 9100 N. Hollywood in Sremerton, the owner of Lot 18, stated <br /> that he had oic!ced up an application for a road vacation last week and he wi11 <br /> be submitting an application to vacate the northern portion of the right-o£-way. <br />
