Findings: The applicant states that the surrounding <br /> neighborhood has nonconforming structures and situations <br /> similar to the conditions of the proposed variance. <br /> Specifically, out of 18 nearby properties, 14 have gazages or <br /> sheds. 9 garages exceed side yard setbacks; 4 garages exceed <br /> rear yard coverage; 8 garages are over property lines or in the <br /> allcy. <br /> b. Conclusions: There are a number of properties in the area <br /> that have accessory buildings that do not meet the setback <br /> requirements. Many of these properties were developed in the <br /> early 1900's and pre-date current zoning code requirements. <br /> The granting of the variance would permit the subject property <br /> the same rights enjoyed by other properties in the area. <br /> Criterion No. 4: <br /> That the variance is the minimum necessary to allow the subject properiy <br /> the gencral rights described in Criterion 3. <br /> a.
