BOARD OF AD.TUSTMSNT <br /> FINDINGS, CONCLUSIONS AND ORDER VARIANCE NO. 33-88 <br /> Based upon the written request for a variance from the City's <br /> zoning code by: <br /> Neal V. Shannon <br /> 1617 Rucker Ave. <br /> Everett <br /> hereinafter referred to as "Applicant," for a variance from <br /> E.N.C. 19.16.040, Para. 2, Accessory Building Lot Coverage, to <br /> allow construction of a 528 square foot, two-car gerage that would <br /> cause the lot coveraqe for accessory buildings to exceed the 900 <br /> square feet allowed by code. <br /> on the property commonly known as: <br /> 1617 Rucker Ave. <br /> The Board of Adjustment, followinq a public hearing on said ' <br /> application held on October 30, 1988, and further havinq reviewad �, <br /> all testimony, mnkes the following Findings, Conclusions nnd ', <br /> Order: <br /> FI1tDINGS 1�lID CONCLUSIONS: <br /> Criterion No. 1• <br /> That there have been exceptionai or extraordinnry circusstances ', <br /> or conditions applyinq to the subject property or as to the in- , <br /> tended use thereof that do not apply generally to othar � <br /> properties in the same vicinity or zone. ; <br /> a. Findino: The subject property is a 75 feet wide by 120 i <br /> feet long lot containing 9,000 equare feet. There is an <br /> existinq 1,590 square foot single family residence on the ', <br /> site end an existing 440 squere foot two car qaraqe. The ', <br /> applicant is proposing to construct a separate 528 squnre ! <br /> fcot two car garaqe in the rear yard area with access off i <br /> the alley. ; <br /> The zoni.ng code was amended in January 1988 to limit the ' <br /> size of accessory structures to l0 percent of the lot �, <br /> area or 3000 squar.e feet whichever is smaller. The total <br /> area of accessory buildings on this site would be 968 , <br /> square feet or 68 square feet over the 900 square feet <br /> the code would allow. <br /> The applicant testified that there are unusual <br /> circumstances applying to the proposed use of the ' <br /> property sinc.e he has three vahicles and a boat, motor <br /> and trailer that he wishes to garaqe. In order to house ' <br /> the boat, motor and trailer he needs a garaqe larqer than <br /> the standard twenty foot by twenty-two foot two car <br /> garage. In the last year, he has had four incidences of <br /> vandalism or theft to his vehicles. <br /> b. Conclusion: There are exceptional and extranrdinary <br /> circumstances applying to the subject property because of <br /> the large lot size (9,000 square feet) and to the use <br /> that is proposed since the larger size structure is <br /> needed to house and protect the applicant�s vehicles, <br /> boat, motor and trailer. The variance the applicant is <br /> requesting is mi;ior, being only a 7� increase over what <br /> the code allows. <br />
