-2- <br />That there are exceptional circumstances applying <br />to the subject property that do not apply to <br />other properties in the same vicinity or zone, <br />specifically that while there is sufficient lot <br />area�to divide the parcel into four lots, the exis- <br />tence of a house on an adjacent property precludes <br />the extension of a publicly dedicated street <br />(49th Street) to provide frontage to the fourth <br />lot. <br />2. That such variance is necessary for the preserva- <br />tion and enjoyment of a substantial property right <br />of the appellant possessed by the owners of other <br />properties in the same vicinity or zone, speci- <br />fically that all other things being equal, the <br />applicant has the right to develop this property <br />into four parcels except for the frontage require- <br />ment, said requirement acing impossible to fulfill <br />because of the adjacent house. <br />3. That the authorization of such variance will not <br />be materially detrimental to the public welfare <br />or injurious to property in the vicinity, speci- <br />fically that other properties will be no more <br />affected by this proposal than by a situation <br />where all four lots fronted on a publicly dedi- <br />cated street. <br />That the granting of this variance will not ad- <br />versely affect the comprehensive plan. <br />In granting this variance the Board imposed the following stipu- <br />lations: <br />1. That the actual driveway to the most westerly lot <br />shall be a minimum of sixteen feet in width and <br />paved with asphalt. <br />That the easement and driveway shall be privately <br />and effectively maintained. <br />3. That additional right of way width, 13.8 feet, shall <br />be dedicated to the City when the property is divided. <br />4. That a utility easement shall be provided across <br />Mr. Brandvold's property at the time it is divided. <br />raring was held on a request of Kenneth Brethauer, 3511 Rucker, <br />a variance from Section 15.04.060 Everett City Code (Zoning) <br />ral Provisions--Non-Conforming Uses; for Permission to Install <br />w sign on a non -conforming use. <br />
