He stated <br />that he wished to replace an old roof mounted sign with a <br />pole sign to upgrade his business and provide better identi- <br />fication of his store. lie stated that the sign would be <br />the same size and same height as the existing sign and would <br />project no more than three feet over public property. There <br />were no questions or comments from the audience. <br />After visually viewing the subject property and considering <br />the facts presented, it was moved by Mr. Baird and seconded <br />by Mr. Berg and unanimously carried to grant this request for <br />the following reasons: <br />1. That there are exceptional circumstances or con- <br />ditions applying to the subject property that <br />do not apply to other properties in the same <br />vicinity or zone, specifically that this is a <br />legal non -conforming use, wishing to improve its <br />appearance by replacing an older sign. <br />2. That such variance is necessary for the preser- <br />vation and enjoyment of a substantial property <br />right of the appellant possessed by the owners <br />of other properties in the same vicinity, <br />specifically that as a non -conforming use, the <br />applicant, while wishing to continue his operation <br />as is his right, desires to enhance his firms iden- <br />tification by installing a more visible sign. <br />3. That the authorization of such variance will not <br />be materially detrimental to the public welfare <br />or injurious to property in the vicinity, <br />specifically that the majority of uses adjacent <br />to this property are non-residential and the <br />street is a heavily travelled, well -lighted arterial. <br />The addition of this sign will not have a signifi- <br />cant effect on this situation. <br />4. That the granting of the variance will not adversely <br />affect the comprehensive plan. <br />In granting this request the Board imposed the following stipu- <br />lations: <br />1. That the base of the pole sign shall be located <br />entirely on private property. <br />2. That the sign shall not exceed the height or size <br />of the existing sign (32 square feet). <br />
