CITY OF EVERETT BOARD OF ADJUSTMENT <br />ORDER <br />WHEREAS, theretofore, there was filed with the City of Everett <br />Planning Department on (date) December 18, 1974 an application for a <br />variance of Section No. 060 of Everett City Code No. 15.04 by <br />(applicant) _Kenneth Brethauer <br />(address) 3511 Rucker <br />for (specific variance requested) Permission to Install a New Sign on <br />a Non -Conforming Use, <br />Zoning: R-4 Multiple family High Density Residence. <br />on the following described property: Lots 6 & 7, Friday's First Addition. <br />AND: WHEREAS, (date) January 6, 1975 was fixed as the date <br />of hearing on said application and proper notice having been given as <br />required by law, <br />AND: WHEREAS, a ��ublic hearing was held on said date and the Board of <br />Adjustment, after reviewing all testimony made the findings that: <br />1. That there are excep'-ional circumstances or conditions <br />applying to the subject property that do not apply to <br />other properties in the same vicinity or zone, specifi- <br />cally that this is a legal non -conforming use, wishing <br />to improve its appearance by replacing an cider sign. <br />2. That such variance is necessary for the preservation and <br />enjoyment of a substantial property right of the appellant <br />possessed by the owners of other properties in the same <br />vicinity, specifically that as a nor. -conforming use, the <br />applicant, while wishing to continue his operation as is his <br />right, desires to enhance his firms identification by in- <br />stalling a more visible sign. <br />3. That the authorization of such variance will not be materi- <br />ally detrimental to the public welfare or injurious to pro- <br />perty in the vicinity, specifically that the majority of uses <br />adjacent to this property are non-residential and the street <br />is a heavily travelled, well -lighted arterial. The addition <br />of this sign will not have a significant effect on this <br />situation. <br />4. That the granting of the variance will not adversely affect <br />the comprehensive plan. <br />NOW, THEREFORE, based on the foregoing findings: <br />BE IT ORDERED BY THE CITY OF EVERETT BOARD OF ADJUSTMENT that said appli- <br />cation be Granted ; with the following stipulations: <br />1. That the base of the pole sign shall be located entirely on <br />private property. <br />2. That the sign shall not exceed the height or size of the <br />existing sign (32 square feet). <br />3. That the sign shall not project more than three feet over <br />public right of way. <br />AND: BE IT FINALLY ORDERED that a copy of this written order be trans- <br />mitted to the applicant for their information. <br />DATE OF ACTION: January 6, 1975 <br />Reid H: Shockey, Secretary <br />Board of Adjustment <br />
