B. the variance is Necessary because of exceptional or extraordinary circumstances regarding <br />the size, shape, topography, or location of the .s►tbject property: or the location of a pre-existing <br />improvement on the subject property that conformed to the Zoning Code in effect when the <br />improvement was constructed. <br />This variance is necessary because the existing site is not large enough to contain a drive through <br />lane with queuing for eight cars, while providing a 100 foot setback between the lane and the <br />residential zone. <br />C. The varimice will only grant the subject property the same general rights ei joyed by other <br />property in the same area mud zone as the subject property. <br />Many surrounding restaurants provide drive through service. Granting of this variance will allow <br />the Taco Time pro; :rty owner to provide this convenience to their customers, enabling them to <br />successfully compete with the surrounding businesses. <br />D. The varitriee is the minimum necessary to allow the subject property the ge►teral rights <br />described in Subsection c of this paragraph. <br />Great effort has been made to reduce the potential impact of this drive -through lane. Taco Time <br />constantly strives to be a good neighbor to their surrounding community, for they rely on <br />residents of the surrounding area to patronize their establishment. The proposed drive -through <br />lane will be provided with noise and headlight protection for the surrounding residential area. <br />This meets the intent of the setback requirements: to protect the surrounding residential areas <br />from the sounds and light of commercial activity. The subject property is not large enough to <br />allow strict compliance with the current code, but by locating the lane as shown , below the base <br />of the rockery, the negative impacts to the neighborhood would be minimized. <br />F. The granting of the variance is trot inconsistent with the goals mid policies of the Everett <br />General Plan. <br />Granting this variance would not compromise the goals of the Everett General Plan. <br />F. Ilre ►teed for requested variance is not the result of a self-created hardship. <br />When the Taco Time Restaurant was built, drive through windows at restaurants did not exist. <br />So planning for a drive -through, way back when the building a as onginally built was not <br />possible.
