9. A Performance Guarantee is required for street improvements on 39th Street prior to any <br />building permits being issued. <br />10. Any broken or damaged sidewalk shall be repaired/replaced at the direction of the City <br />Public Works Inspector. <br />11. A 6 inch clean -out must be installed on the side sewer for thu building at the point it turns <br />to flow toward Rucker Avenue. <br />12. Compliance with fire code regulations is required prior to use of the structure for <br />commercial purposes. <br />13. Landscaping for the site must be provided in accordance with Section 35 of the Zoning <br />Code. This would include at a minimum a 10' wide strip along the street frontage and a <br />minimum 5' wide stnip along all other property tines planted to Type III standards. A <br />detailed landscaping plane mot be approved poor to issuance of am boil t. <br />14. Any future change of use of the property will regwre review by the Planning Department <br />to determine if the new use meets the intent of this pertnit or if it will require a new <br />application. <br />Compliance with the eooditions stated in this approval are required prior to 8se of the <br />stricture for commercial purposes.
