1` <br />1 <br />CITY OF EVERETT USE PERMIT O-9! <br />Applicant: Nhuan Duc Ly <br />833 5th Street <br />Mukilteo, WA 98275 <br />Location: 3828 Rucker (NW corner of 39th and Rucker) <br />Existing/Proposed Use: Conversion of a 1,504 square foot single family <br />residence to retail use. <br />Zoning: B-2, Community Business <br />Parking required: 1 space per 300 square feet. Based upon 1,504 square <br />feet, a mummum of five spaces is required for the <br />proposal. <br />A permit for the above described change of use is hereby granted with the following conditions <br />that must be met prior to use of the buildiet for commercial nuruom: <br />1. Parking area must be per City Zoning Code and City Design and Construction Standards <br />and must be paved. On street parking may not be counted in m" the total number of <br />required arid stalls. The parking stall in the garage and the call immediately adjacent <br />to in (in front of the garage door) must be labeled and used as employee parking. <br />2. Detailed drawings in accordance with City Design and Construction Standards shall be <br />submitted to the Public Works Department, showing site parking layout, landscaping, <br />utilities, storm drainage, temporary construction erosion control, and all required <br />improvements in the public right-of-way. Public Works Department approval of these <br />drawings is required prior to any permits being issued. All improvements shall be <br />completed and approved warranted before the Occupancy Permit is issuedtfinal approval <br />is granted. <br />3. A-1 curb and gutter must be installed and the sidewalk replaced per City Design <br />Standards on the proposal's 39th Street frontage. <br />4. Any grading/fill on this site shall be done so as to not impact the surrounding properties. <br />5. New construction (including plumbing & wiring) will be required to comply with the <br />current state building code. Access for the disabled must be provided to the building. <br />6. Lack of comment on the plans submitted with the application does not constitute approval <br />of these plans. <br />7. A fire hydrant is required within 200 driving feet but no closer than 50 feet of every <br />structure. <br />8. City streets and alleys are to be kept clear of dirt and debris at all times during <br />construction. Dust suppression and street cleaning must occur as directed by the Public <br />Works Inspector. <br />
